1. Acceptance of Terms

Welcome to Archive! By accessing or using the Archive mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Archive. We may update these Terms from time to time to reflect changes to our Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

2. Beta / Test Service

Archive is currently being made available to a limited number of users for testing and feedback purposes. During this beta period, the Service is provided free of charge and certain features may change, break, or be discontinued without notice.

We may introduce additional features, including paid or subscription features, in the future. Your current access does not guarantee continued free access.

3. Eligibility

You must be at least 13 years old to use Archive. By using the Service, you represent and warrant that you meet this age requirement.

If you are between 13 and 17 years old, you must have your parent or legal guardian's permission to use the Service. By using Archive, you confirm that you have obtained such permission.

For virtual try-on or features that require uploading personal photos, you must be at least 18 years old or have explicit parental consent. We may restrict or disable photo-based features for users we believe are under 18 or do not have consent.

4. Description of Service

Archive is a fashion trend discovery and style platform that provides:

  • Curated and ranked information about trending fashion brands and products
  • AI-powered explanations, outfit suggestions, and virtual try-on experiences
  • The ability to save and organize products in a digital closet
  • Vision/lookbook boards for styling and inspiration
  • Links to third-party retailers where products can be purchased (Archive does not sell products directly)

To provide these features, Archive may automatically collect, analyze, and derive information from publicly available online sources and third-party platforms (e.g. social content, fashion discussions, search interest, and resale signals) in order to generate trend insights.

Important: Archive is an informational and styling service only. We do not sell products, process payments, or fulfill orders. All purchases are made directly through third-party retailers.

5. User Accounts

5.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

5.2 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

You may delete your account at any time through the app settings. Upon deletion, your personal information will be removed in accordance with our Privacy Policy.

6. User-Generated Content, Boards, and Image Uploads

6.1 Your Content

You may upload photos, images, inspiration items, and other content to Archive, including for virtual try-on, closet items, and vision board creation. You retain all ownership rights to content you upload.

6.2 License Grant

By uploading content, you grant Archive a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you. This includes processing your photos through third-party AI technology (such as OpenAI or FASHN) to generate virtual try-on results or style outputs, and storing board/layout positions so your boards look the same when you return.

6.3 Content Guidelines

You agree that any content you upload will NOT:

  • Contain nudity, sexually explicit, or inappropriate material
  • Depict minors in any manner
  • Violate any person's privacy or publicity rights
  • Contain violent, hateful, or discriminatory content
  • Infringe on any third party's intellectual property rights
  • Contain malicious code or viruses

6.4 Content Removal

We may remove any content that violates these Terms or is otherwise objectionable, at our sole discretion and without notice.

You can delete your uploaded content at any time through the app. Deleted content will be permanently removed from our systems within a reasonable period (typically up to 30 days).

7. Virtual Try-On and AI Features

Our virtual try-on and styling features use artificial intelligence to generate images or suggestions. These results are approximations and may not match real-world fit, color, or availability.

Important Disclaimers:

  • AI results may be inaccurate or incomplete.
  • Results should not be relied on as the sole basis for purchase decisions.
  • We are not responsible for dissatisfaction with purchases made after using AI features.

By using these features, you consent to your content being processed by our AI service providers. See the Privacy Policy for more details.

8. Biometric and Image-Based Information

Some features of the Service (for example, virtual try-on) may require you to upload a photo of your face or body so we can generate a style visualization. By uploading such a photo, you:

  • Explicitly consent to Archive collecting and using image-based information for the sole purpose of providing the requested feature;
  • Acknowledge that we may share the image with third-party AI processors solely to create the visualization or output you requested;
  • Acknowledge that we do not sell or otherwise profit from your biometric or image-based information;
  • Acknowledge that we will retain such information only as long as reasonably necessary to provide the feature to you or as required by law, and will delete it upon account deletion or your request, subject to technical limits;
  • Represent that the image is of you, or that you have all necessary permissions to upload it.

Certain U.S. states (including Illinois, Texas, and Washington) have specific laws governing the collection and use of biometric identifiers and information. Where applicable, your consent under this section is intended to satisfy those requirements.

9. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Scrape, crawl, or automatically collect data from the Service
  • Interfere with or disrupt the Service
  • Impersonate any person or entity
  • Upload malicious code or viruses
  • Spam or harass other users
  • Use the Service to compete with Archive
  • Upload photos of other people without their consent

We may use automated means to collect and analyze publicly available fashion content and related metadata from third-party platforms in order to provide the Service. This automated collection by Archive is separate from the restrictions on your use above.

10. Intellectual Property

10.1 Our Content

All content on Archive, including but not limited to text, graphics, logos, images, data compilations, rankings, and software, is owned by Archive or its licensors and is protected by intellectual property laws.

10.2 Third-Party Content

Product images, brand logos, and descriptions are the property of their respective owners. We display this content for identification and informational purposes only. If you believe your intellectual property rights have been violated, please contact us.

10.3 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

11. Third-Party Links and Transactions

The Service may contain links to third-party retailers or platforms. These links are provided for your convenience only.

Important Disclaimers:

  • Archive is not responsible for any transactions with third-party retailers.
  • We do not guarantee product availability, pricing, or quality.
  • We are not liable for any issues with orders, shipping, or returns.
  • All purchase disputes must be resolved directly with the retailer.

During beta, Archive does not collect commissions or fees from your purchases. We may add such features in the future and will update these Terms if we do.

12. Fees, Subscriptions, and App Store Terms

The Service is currently provided without charge during beta. We may, in the future, offer paid tiers, subscriptions, in-app purchases, or premium features. If we do, some or all billing and cancellations may be handled by the Apple App Store or Google Play Store, and their terms may apply (including auto-renewal and refund rules).

We will notify you in the app if a feature requires payment and will present the applicable pricing and terms before you are charged.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Information on the Service is accurate or complete
  • AI or virtual try-on results will be accurate or realistic
  • Defects will be corrected
  • The Service is free from viruses or harmful components

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

This includes, but is not limited to:

  • Loss of profits, data, or goodwill
  • Service interruptions
  • Issues with third-party purchases
  • Unauthorized access to your account or uploaded content
  • Inaccurate AI or virtual try-on results

If you are dissatisfied with the Service, your sole remedy is to stop using it.

15. Indemnification

You agree to indemnify and hold harmless Archive, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload to the Service

16. Copyright / DMCA

If you believe that content on the Service infringes your copyright, please notify our designated DMCA agent with a detailed notice. Once we receive a proper notice, we will respond in accordance with the Digital Millennium Copyright Act (DMCA).

17. Dispute Resolution and Governing Law

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois and applicable federal law of the United States, without regard to its conflict of laws principles.

17.2 Binding Arbitration & Class Waiver

You and Archive agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service will be settled by binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules. Arbitration will take place in Chicago, Illinois, unless we both agree otherwise.

YOU AND ARCHIVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@archivecloset.com and stating that you wish to opt out of arbitration. If you opt out, you agree to the exclusive jurisdiction of the state and federal courts located in Chicago, Illinois.

18. Changes to Service

We may modify, suspend, or discontinue the Service (or any part of it) at any time without notice, especially during the beta period. We are not liable for any modification, suspension, or discontinuation.

19. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

20. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, internet or utility failures, or government actions.

21. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Archive regarding the Service and supersede all prior or contemporaneous agreements.
